1) Purchased tickets are valid for use within the applicable exhibition period.

* The exhibition period may be extended or shortened depending on the circumstances of the exhibition hall.

3) This is a media art exhibition that is very dark inside and loud. If you are claustrophobic or have infants, young children, pregnant women, or the elderly, please be aware before visiting.

Terms and Conditions for Using E-Commerce (Online Mall)

Article 1 (Purpose)

These terms and conditions apply to the services (hereinafter referred to as “services”) provided by the online mall (deslumieres.co.kr: hereinafter referred to as the “Mall”) operated by TMONET, and stipulate the rights, duties, and responsibilities of the online mall and its users.

Article 2 (Definition)

① The “Mall” refers to a virtual business site that TMONET has established with information and communication systems, such as computers, to supply goods or services (hereinafter referred to as “goods, etc.”) and could also mean the operator of the online mall.

② The “user” refers to members and non-members who access the “Mall” and receive the Services provided by the “Mall” following these terms and conditions.

③ The "member” refers to a person who has signed up for the membership of the “Mall” and is entitled to the services provided by the “Mall”.

④ The “non-member” refers to a person who uses the services provided by the “Mall” without subscribing to its membership.

Article 3 (Specification, Explanation, and Revision of the Terms and Conditions)

① The “Mall” shall disclose the terms and conditions, company name, representative, company address (including the address of a unit to handle consumer complaints), phone number, fax number, e-mail address, business registration number, telemarketing business registration number, a privacy protection officer, etc. on the main page of its website to help the users’ understanding of such information. However, the contents of the terms and conditions may be provided through a link connecting to a separate page.

② Before a user submits consent to these terms and conditions, the “Mall” shall provide key information about the terms and conditions, such as the cancelation of purchase requests, responsibility for delivery, and refund conditions, on a connected page or a pop-up window to help the users’ understanding and ask for their confirmation.

③ The “Mall” may revise these terms and conditions to an extent not violating relevant laws: 「Act on Consumer Protection in Electronic Commerce」, 「Act on the Regulation of Terms and Conditions」, 「Framework Act on Electronic Documents and Transactions」, 「Electronic Financial Transactions Act」, 「Digital Signature Act」, 「Act on Promotion of Information and Communications Network Utilization and Information Protection」, 「Act on Door-to-Door Sales」, and 「Framework Act on Consumers」.

④ When it intends to revise these terms and conditions, the “Mall” shall post the date of and reasons for revision as well as the existing terms and conditions on the main page of its website seven days prior to the date of revision. However, this notice period shall be extended to at least 30 days if the revision of the terms and conditions includes unfavorable changes to the users. In this case, the “Mall” shall provide a clear comparison of the difference between the existing and revised terms and conditions to help the users’ understanding.

⑤ Any revision of the terms and conditions shall apply only to future contracts to conclude after the date of revision and does not apply retrospectively to the existing contracts. However, a user may have his/her existing contract subject to the revised terms and conditions by notifying the “Mall” of his/her intent as such and receiving its consent during the notification period outlined in this Article.

⑥ Matters not specified in these terms and conditions and the interpretation of these terms and conditions shall follow the Consumer Protection Act in Electronic Commerce, etc., the Act on Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, etc. set by the Fair Trade Commission, related laws, and commercial practices.

Article 4 (Provision and Change of Services)

① The “Mall” shall perform the following activities.

1. Provide information on goods or services and conclude purchase contracts.

2. Deliver goods or services following purchase contracts.

3. Other tasks defined by the “Mall”

② In case goods or services are out of stock or their technical specifications change, the “Mall” may reflect such changes in future contracts. In this case, the “Mall” shall notify the changes in goods or services and their delivery dates without delay on the same page where such information on the existing goods or services is posted.

③ If the services the “Mall” has agreed to supply to a user under a contract have to be changed due to goods being out of stock or technical specification change, the “Mall” shall notify the user of the reasons without delay at an address where the user can be reached.

④ In this case, the “Mall” shall compensate the user for the damages inflicted by such changes. However, the “Mall” may bear no such responsibility if it proves such changes were not the result of its deliberate act or negligence.

Article 5 (Suspension of Services)

① The “Mall” may temporarily suspend the provision of services in the event of repair, inspection, replacement, or breakdown of information and communication equipment such as computers, or the disruption of communication.

② In the event that the provision of services is temporarily suspended due to any of the reasons stated in Paragraph 1, the “Mall” shall compensate the users or third parties for damages arising therefrom. However, the “Mall” may bear no such responsibility if it proves such disruption was not the result of its deliberate act or negligence.

③ In the event that the “Mall” can no longer provide service due to such reasons as the change of its business category, giving up its business, or merger between companies, it shall notify the users of such matters in ways stated in Article 8 and compensate the users following the terms and conditions the “Mall” has suggested at the outset. Had there not been any standards for compensation previously notified, the “Mall” shall pay the users their mileage or reserves in goods or cash equivalent to the currency value set in the “Mall”.

Article 6 (Membership)

① A user may subscribe to membership by filling in the subscription form provided by the “Mall” and expressing his/her intent to agree to these terms and conditions.

② The “Mall” may register the user who submitted the subscription form set forth in Paragraph 1 as a member, unless he/she falls under any of the following categories;

1. The user has previously been disqualified from membership under Article 7, Paragraph 3 of these terms and conditions. However, this clause does not apply to a user who has passed three years since such disqualification and whose resubscription of membership is approved by the “Mall”.

2. The subscription form contains false information, omission, or errors.

3. The registration of the user is not possible due to a technical constraint of the “Mall”.

③ The membership subscription shall be regarded to be complete when the user receives the consent of the “Mall”.

④ In the event any of the information stated in his/her subscription form is changed, the user shall notify such changes to the “Mall” by revising member information within a substantial period.

Article 7 (Withdrawal from Membership and Disqualification)

① A member may request a withdrawal from membership at any time to the “Mall”, in which case the “Mall” shall process the withdrawal without delay.

② The “Mall” may restrict or suspend the membership of a member who falls under any of the following categories;

1. The member stated false information in the membership subscription form.

2. The member failed to pay for goods purchased in the “Mall” or debt to pay concerning the use of other services in the “Mall” on the due date.

3. The member interrupted other people’s use of the “Mall” or steal their information, thereby threatening the order of e-commerce.

4. The member used services in the “Mall” in violation of relevant laws, these terms and conditions, public order, and good morals

③ After the restriction or suspension of membership, the user who repeats the same misconduct two times or more, or fails to rectify such misconduct within 30 days may be disqualified from membership by the “Mall”.

④ The “Mall” will terminate the registration of a member who is disqualified. In this case, the member will be notified of such termination and granted at least 30 days of grace period to explain his/her position before the termination.

Article 8 (Notification to Members)

① The “Mall” may send the members notices via the e-mail addresses previously provided by the members.

② A notice to non-specific members may be substituted for by posting a notice on the bulletin board of the “Mall” for more than one week. However, the “Mall” shall send individual notices to the members for important matters relating to their transactions.

Article 9 (Application for Purchase and Consent to Personal Information Provision)

① A user of the “Mall” may make a purchase request on the “Mall” by the following methods or any other methods similar to them, and the “Mall” shall provide sufficient guidance to help the user understand how to request a purchase.

1. Search and select goods, etc. to purchase

2. Enter the name, address, phone number, e-mail address (or mobile phone number) of the person who will receive the goods, etc.

3. Check the terms and conditions, services with a limited right to cancel purchase requests, costs (e.g., shipping and installation), etc.

4. Indicate one’s consent to the terms and conditions and confirmation or rejection of the items stated in Paragraph 3 of this article. (e.g., click with a mouse)

5. Make purchase requests for goods, etc., confirm the purchase requests, or express one’s consent to the confirmation by the “Mall”.

6. Select a payment method

② In case the “Mall” needs to provide buyers’ personal information to a third party, the “Mall” shall notify the buyers of 1) the recipient of personal information, 2) the purpose for which the personal information will be used by the recipient, 3) items of personal information to provide, 4) the period for the recipient to retain and use personal information, and shall obtain their consent. (This provision applies also when there are changes to the matters the buyers have consented)

③ In case the “Mall” entrusts a third party to handle the personal information of buyers, it shall notify the buyers of 1) the person entrusted with the handling of personal information and 2) the tasks to be entrusted, and shall obtain their consent (This provision applies also when there are changes to the matters the buyers have consented). However, if the purpose of such entrustment is to fulfill contracts for service provision and enhance users’ convenience, the procedures of notification and consent may be substituted for by the guidelines of the “Mall” on personal information management as outlined in the 「Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc.」

Article 10 (Establishment of Contract)

① The “Mall” may not accept a purchase request made under Article 9 if the purchase request falls under any of the following categories. When entering into a contract with a minor, the “Mall” shall notify that a contract for which the legal representative’s consent was not obtained may be canceled by the minor or his/her legal representative.

1. The purchase request contains false information, omissions, or errors.

2. A minor purchases goods and services banned by the Youth Protection Act, such as cigarettes and alcohol.

3. The “Mall” deems accepting the purchase request is not possible due to a technical constraint of its systems.

② The contract shall be regarded to be concluded when the consent of the “Mall” reaches the user via receipt confirmation notice as outlined in Article 12, Paragraph 1.

③ In its acceptance of the purchase request, the “Mall” shall specify its confirmation of the user's purchase request, availability of goods, etc., and correction and cancellation of the purchase request, etc.

Article 11 (Payment Method)

The users may make a payment for goods or services purchased at the “Mall” by any of the following methods. The “Mall” cannot collect any type of fees from the users, other than the price of goods, etc.

1. Bank remittance: telephone banking, online banking, and mail banking

2. Payment by cards: prepaid cards, debit cards, and credit cards

3. Online deposit without a bankbook

4. Payment by digital cash

5. Payment upon the receipt of goods, etc.

6. Payment by points a user has accumulated in the “Mall” such as mileage

7. Payment by gift certificates under contracts with or recognized by the “Mall”

8. Payment by other electronic methods

Article 12 (Receipt Confirmation Notification, Change and Cancellation of Purchase Request)

① The “Mall” shall send a receipt confirmation to users who made a purchase request.

② A user who finds any discrepancies of intent with the “Mall” in the receipt confirmation may immediately ask for change or cancel his/her purchase requests, and the “Mall” shall follow up on without delay such requests made before the delivery of goods, etc. However, purchase requests for which payment was already made shall be handled following Article 15 (Cancelation of Purchase Request).

Article 13 (Supply of Goods, etc.)

① The “Mall” shall take necessary measures, such as custom production and packaging, to deliver goods, etc. to a user within seven days from the date of purchase unless the delivery period is otherwise agreed upon under a separate arrangement between the “Mall” and the user. In case the “Mall” has received all or part of the payment for goods, etc., the “Mall” shall take measures to ensure the goods, etc. will be delivered within three business days from the date of the payment. In this case, the “Mall” shall take appropriate measures to let users access and view the supply process and progress of their purchased goods, etc.

② The “Mall” shall specify different delivery methods, who pays for the delivery cost, delivery period, etc. for the goods purchased by users, and shall compensate the users for damages caused by the delay of delivery surpassing the specified delivery period. However, this provision does not apply when the “Mall” proves the delay was not the result of its deliberate act or negligence.

Article 14 (Refund)

In the event the goods, etc. for which a user placed a purchase request cannot be delivered or supplied due to such reasons as being out of stock, the “Mall” shall notify the user of the reason without delay. In case the user has already paid for the goods, etc., the “Mall” shall refund the payment within three business days or take measures necessary for refunding.

Article 15 (Cancelation of Purchase Requests)

① A user who has entered into a purchase contract for goods, etc. with the “Mall” may cancel the purchase request within seven days from the date he/she receives the contract in writing under Article 13, Paragraph 2 of the 「Act on Consumer Protection in Electronic Commerce」.

② A user cannot return or exchange goods, etc., after delivery if he/she falls under any of the following categories:

1. The goods, etc. were lost or damaged due to reasons attributable to the user (Yet, this clause does not apply to the users who simply unpacked the goods, etc. for checking the contents.)

2. The value of the goods, etc. was substantially decreased due to the user's use or partial consumption of the goods, etc.

3. The value of goods, etc. was substantially decreased due to the lapse of time to the extent that the goods, etc. cannot be resold.

4. The packaging was unpacked for the goods, which can be copied into other goods of the same performance.

③ Items 2 to 4 of Paragraph 2 in this Article may not apply and users will not be restrained from canceling purchase requests in case the “Mall” fails to notify in advance consumers of these restrictions on purchase request cancellation with clarity or to provide trial products.

④ Notwithstanding Paragraphs 1 and 2, in case the purchased goods, etc. are different from what was stated in the specification or advertisement or the purchase contract is not properly fulfilled, the users may cancel their purchase requests within three months from the date of delivery or within 30 days from the date they were or could have been aware of such failures.

Article 16 (Effects of Purchase Request Cancellation)

① The “Mall” shall refund the payment of goods within three business days after a user returns purchased goods, etc. In case, the refund of goods, etc. is delayed, the “Mall” shall pay the user interest in arrears calculated by multiplying the interest rate in arrears stipulated in Article 21-3 of the Enforcement Decree of the Consumer Protection Act in Electronic Commerce with the delayed period.

② In refunding the goods, etc. paid for by credit cards or digital cash, the “Mall” shall request without delay the business operators providing such means of payment suspend or cancel claiming payments for the goods, etc.

③ The users who cancel purchase requests shall bear the cost of returning the goods, etc. they have received. The “Mall” shall not claim the users a penalty or compensation for damage by reason of such cancellation. The cost of returning goods, etc. shall be borne by the “Mall” if a user cancels a purchase request as the purchased goods, etc. are different from what was stated in the specification or advertisement or the purchase contract is not properly fulfilled.

④ In case a user pays the delivery cost for goods, etc., the “Mall” shall provide an easy and clear explanation of who bears the cost for the goods, etc. whose purchase request is canceled.

⑤ Terms and conditions for cancellation and refund may differ depending on the types of goods and services provided by the “Mall”.

Article 17 (Protection of Personal Information)

① The “Mall” may collect the users’ personal information to the minimum extent required to provide service to the user.

② To collect and use personal information, the “Mall” shall notify the users of the purpose and obtain their consent to the collection and use of their personal information.

③ The “Mall” cannot use the collected personal information for other purposes than the ones agreed upon by the users. When the “Mall” needs to use personal information for a different purpose or provide it to a third party, the “Mall” shall notify the users of such purposes and obtain their consent when it intends to use or provide personal information. However, this paragraph does not apply when relevant laws and regulations stipulate otherwise.

④ The “Mall” shall specify or notify the identity of the privacy management officer (e.g., affiliation, name, phone number, other contacts, etc.), the purpose of collecting and using personal information, and matters stipulated in Article 22, Paragraph 2 of the 「 Act on Promotion of Information and Communications Network Utilization and Information Protection」, such as personal information provided to a third party (e.g., recipient, purpose, information to provide), in order to obtain the users’ consent following Paragraph 2 of this Article. The users may withdraw their consent at any time.

⑤ A user may demand access to and correction of errors on his/her personal information kept by the “Mall” at any time, in which case the “Mall” shall take necessary measures without delay. If a user demands correction of an error in personal information, the “Mall” shall not use the personal information until the error is corrected.

⑥ The “Mall” shall have the personal information of users be handled only by a minimum number of personnel and take all responsibilities for damages inflicted on the users by the loss, theft, leakage, or provision of personal information to a third party without their consent, and alteration of personal information, including credit cards and bank accounts.

⑦ The “Mall” or a third party who received personal information from the “Mall” shall destroy the personal information without delay when the purpose of collecting or receiving the personal information is achieved.

⑧ The “Mall” shall not set a user’s consent slot for the collection, use, and provision of personal information marked as default. In addition, the “Mall” shall specify services unavailable to users who refuse to consent to the collection, use, and provision of personal information, and it cannot limit or refuse the provision of services such as membership subscription to the users who refuse to consent to the collection, use, and provision of non-mandatory personal information.

Article 18 (Obligations of the “Mall”)

① The “Mall” shall not engage in acts in violation of the laws, these terms and conditions, public order, and morals, and shall devote its best efforts to ensure the stable and continuous provision of goods and services according to these terms and conditions.

② The “Mall” shall put in place a security system to protect the users' personal information (including credit information) and ensure the users can safely use online services.

③ If the “Mall” engages in unfair indication or advertisement of goods or services as stipulated in Article 3 of the 「Act on Fair Labeling and Advertising」 and as a result causes damages to the users, it shall be held responsible for compensation.

④ The “Mall” shall not send commercial e-mails for advertisements that the users do not want to receive.

Article 19 (Obligations for Member IDs and Passwords)

① The members shall be responsible for managing their IDs and passwords except for the cases stipulated in Article 17 of these terms and conditions.

② The members shall not let a third party use their IDs and passwords.

③ When a member finds out that his/her ID and password were stolen or are used by a third party, the member shall notify the “Mall” without delay and follow the instructions of the “Mall”, if any.

Article 20 (Obligations of Users)

The users shall not engage in the following acts.

1. State false information when making requests or revisions.

2. Steal other people's information.

3. Change information posted on the “Mall”.

4. Send or post other information (e.g., computer programs) than what is specified by the “Mall”.

5. Infringe the intellectual property rights of the “Mall” and third parties, such as copyrights.

6. Taint the reputation of the “Mall” or third parties, or interfere with their business activities.

7. Disclose or post obscene or violent messages, images, voices, or other information violating public order and morals on the “Mall”

Article 21 (Relationship between Connecting “Mall” and Connected “Mall”)

① In case a main “Mall” and a subordinate “Mall” are connected by hyperlinks (e.g., hyperlinks to texts, pictures, and dynamic images), the former is called the connecting “Mall” (website), and the latter is called the connected “Mall” (website).

② The connecting “Mall” may indicate on the main page of its website or a window popping up when a user moves to the connected “Mall” that it does not bear responsibility for transactions between the connected “Mall” and the users over goods, etc. supplied independently by the connected “Mall”. In this case, the connecting “Mall” does not bear responsibility for such transactions.

Article 22 (Attribution of Copyright and Restrictions on its Use)

① Copyright and any other intellectual property rights for the works created by the “Mall” belong to the “Mall”.

② Out of the information a user obtains in the course of using the “Mall”, the user cannot use information whose intellectual property rights belong to the “Mall” without its prior approval for commercial purposes by copying, transmitting, publishing, distributing, broadcasting or any other methods, or cannot let a third party use it.

③ In case the “Mall” uses the copyright that belongs to a user under an agreement, the “Mall” shall notify the user of such copyright use.

Article 23 (Resolution of Disputes)

① The “Mall” shall install and operate a compensation organization to reflect the users’ legitimate opinions or complaints and to compensate for damages.

② The “Mall” shall place a priority on managing the users’ complaints and opinions. In case handling a user’s feedback is delayed, the “Mall” shall notify the user of the reason for the delay and the expected resolution schedule.

③ In the event that a user applies for remedy over a dispute the “Mall”, this case may be addressed following mediation by the Fair Trade Commission or a dispute mediation agency requested by the mayor or provincial governor.

Article 24 (Jurisdiction and Governing Law)

① A lawsuit for a dispute over online transactions between the “Mall” and a user shall be filed with the district court that has exclusive jurisdiction over the user's address at the time of filing. If there is no specified address of the user, the district court that has jurisdiction over the user’s place of residence shall have exclusive jurisdiction. However, if the user has no specified address or residence at the time of filing, or if the user is a foreign resident, the lawsuit shall be filed with the competent court under the Civil Procedure Act.

② Lawsuits filled between the “Mall” and its users shall be governed by the laws of the Republic of Korea.
